I never would have thought that it would be October before I got compensated from uninsured motorist fund...back in August when the crash happened. It seems that the proper amount of time has finally elapsed to move on this case sinse the un-insured driver who pulled out in front of me has NOT been willing to sign an affadavit admiting that he has no auto insurance. So this comming week, I need to wait for MORE paperwork to arrive to me via UPS to fill out and return with the title to my destroyed car. THEN when they receive that, they will send me the check for my loss, and provide a rental car for 7-10 days to allow me time to shop for a vehicle. I am worried that the amount that I receive shall be very low because the total loss unit considers the MILEAGE as well as the age of the car when determining the amount I shall receive for damages. I don't get down to the library very often now to get on-line because the walk from my apartment is SO long (4 miles rount trip) that it takes so much out of me due to my neuropathy in both feet.

Sometimes I wonder if it's all worth while ... the waiting to no end then lo and behold, the check is in the bank Hurray!!!
It only took three years, but it was worth the wait

It is against the law to not have at least liability in the state of Arkansas. Not sure about W.V. But I think if you come out in the red on this, then you need to take him to small claims court and sue his ass.

When my car was totalled, a number of years ago, they offered me next to nothing to settle. They use a different schedule for calculating cost. I checked what it would cost to replace my car with the exact same make, model, and year...and told them I wanted that much money for it...so I could replace my car precisely. When they argued with me, I simply said I'd be happy to let a jury decide if I should be out my transportation because their client failed to stop at a stop sign. They sent me the exact amount I asked for.
I've often found insurance companies frustrating, but when you make a reasonable argument and aren't asking to make money off the event, they are usually willing to work with you rather than spend the money to fight you. Mileage counts, but realistically, the car was operable and should be replaced in such a way that you can continue to get around. It would make them look very unreasonable in front of a jury to cheat you...particularly with your disability.

I think it would be like squeezing blood out of a turnip. I spoke with legal counsel about it and they told me that motorists who drive without auto insurance generally don't have ANY money.

Overwhelmed by all the smileys here! Anyway...I managed to pop in today. I have a rental car for the week while I wait for the diminutive settlement check to arrive from the uninsured motorist fund. Hope all is well with you!

If the driver at fault had insurance, I would have MUCH more leverage than I do now. I havd done the exact thing as you did in the past with drivers at fault who had legitimate auto insurance. As soon as I mentioned litigation, they suddenly became quite agreeable!

2 years is an eternity! (Neuropathy is a sensation in my feet caused by permanently damaged nerves. It feels like being stung by thousand bees at once while standing in hot oil if I am not medicated.) Fourtanetly my current pain management keeps MOST of the pain at bay for me now! No injuries from accident. Seat belt kept me from getting seriously banged up.

Unfortunately, I will die with this ailment. (It is permanent and there is NO cure). As long as I am on the very strong pain killers, I am OK most of the time, though.

You know...when your insurance company fails to live up to the coverage they agreed to provide, it's called "Bad Faith"....and often worth a small fortune. Don't be afraid to use the terminology if that's what it takes to get what's right. Having your vehicle back is not an unreasonable request.

SO tired of waiting. Maybe I can get something for pain and suffering through the medical part of the claim. I doubt that the doctor will be cooperative in the report, though.

Neuropathy on feet > make sure to stop smoking if you do smoke.. hope you regularly monitor your blood sugar and oxygen levels. Oh don't rely too much on strong pain killers to mute your pain, your body will adopt to it.. try Acupuncture or exercise it can still help reduce the pain
Hope all is well now.

Going along with Ling's suggestions of trying wholistic/alternative healthcare, have you tried using essential oils? I have seen essential oils take care of a lot of things, even things that were deemed as "incurable" or "permanent" by doctors. It wouldn't hurt you to try them. At least your feet will smell great and EVERYBODY wants great smelling feet, don't they?

Blood is good. Sugar only 88, chloesterol 13. Accupuncture is a fraud. I tried it. VERY painful. The ONLY pills that work are the lyrica, dilaudid, and morphine

I will stick with the pain killers. They work good and I can get some sleep and stay healthy.
